Making a notification under EU Directive 2019/1937 on the protection of whistleblowers

Submission of notifications pursuant to Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons reporting infringements of Union law (the "Directive"):

In accordance with the Directive, the College of Polytechnics Jihlava (hereinafter also referred to as the "HPSJ") informs whistleblowers whose rights are protected about the notification process.

The benefit of the Directive for whistleblowers is protected status, the whistleblower shall not be subject to retaliation.

The benefit to the HEI is the ability to detect potential defective practices and activities in a timely manner.

A whistleblower may be an employee, job applicant, intern, contractor or prospective contractor, etc.

The Directive does not protect whistleblowers who knowingly misrepresent facts.

What can be notified under the Directive

Information by a natural person about a possible violation of the commission of which has come to the attention of the notifier in connection with work or other similar activity,

  • which has the characteristics of a criminal offence or misdemeanour; or
  • violates an EU law or regulation governing the areas set out in the Directive.

How to submit a notification

  • in writing to oznameni@vspj.cz
  • by telephone: 567 141 106 ( 8.00 am - 3.00 pm )
  • in person (by arrangement with the relevant person)
  • in writing in paper form, i.e. by letter in a sealed envelope, which must be legibly marked "NOTICE OF VIOLATION OF EU LAW - DO NOT OPEN"; to the school address ( VŠPJ, Tolstého 1156/16, Jihlava, 586 01 )
  • via the external notification system of the Ministry of Justice notifier
  • by publication (if the statutory conditions are met)

 

The HEI has an internal notification system in place for receiving notifications, which guarantees the anonymity of the channels for notifications and for the management of individual submissions and includes the setting of deadlines for the handling of notifications.

Responsible person

The Competent Person is the only person allowed to read the notifications and therefore assess them

Notification process

  1. Notification can be made orally or in writing, or at the request of the notifier in person.
  2. The competent person must notify the notifier of the receipt of the notification within 7 days.
  3. Within 30 days, must notify the notifier of the outcome of the review.
  4. The time limit may be extended twice for 30 days.
  5. The competent person must propose measures to prevent or remedy the violation.
  6. The notice will be kept on file for 5 years.
